Brazilian court overturns Nelson Piquet's fine for controversial Lewis Hamilton remarks
A Brazilian court has revoked the hefty fine imposed on former Formula 1 driver Nelson Piquet for comments directed at Mercedes' Lewis Hamilton.
Piquet's remarks, made in response to the 2021 British Grand Prix incident involving Red Bull driver Max Verstappen and Hamilton, had ignited a contentious debate, as he referred to Hamilton as 'neguinho,' a Portuguese term that translates to 'little Black man'.
Piquet defended his choice of words, asserting that he did not intend any racial connotation, rather suggesting it could be used as a colloquial term to describe any person. He did, however, express regret for his poorly considered comments.
Human rights groups in Brazil pursued legal action against Piquet, ultimately resulting in a fine of five million Brazilian Reals, equivalent to approximately £811,709 GBP, at the prevailing exchange rates. Yet, according to reports by Brazilian outlet Metropoles, the Court of Justice of the Federal District and Territories, with jurisdiction over Brasilia, has now reversed the fine imposed on Piquet.
The court ruled in favour of Piquet's defence, stating that his comments should be categorized as mockery rather than hate speech. The judge emphasized, "There is no demonstration of hate speech. The use of terms from colloquial [informal] language, even if riddled with subtle or involuntary racist inspiration, even if inappropriate, does not carry sufficient gravity and relevance to characterize the collective damage."
This unanimous decision is expected to be appealed to the Supreme Federal Court, the highest legal authority in Brazil.
In a separate controversy, Piquet had accused Hamilton of homophobia for using the phrase "giving ass". However, the court contested this charge, arguing that such language could also be applicable to heterosexual relationships.
The Formula 1 calendar is poised for a thrilling race on October 22 in Austin, Texas. The United States Grand Prix, held at the 5.5-kilometre Circuit of the Americas.
